Lindborg & Drill Succeed at Mediation
The agency in charge of all major transportation projects in San Diego County recently chose the lawyers of Lindborg & Drill LLP to represent its interests in a mediation involving a claim of over $13,000,000 brought by a contractor concerning the automated toll collection system used on all buses and trains in the county.  Called in late in the claims process, the lawyers of Lindborg & Drill literally worked around the clock to produce the agency’s mediation presentation.  In analyzing the claim, the lawyers of Lindborg & Drill identified several significant issues affecting the validity of the claim.  As a result, the claim was settled for approximately 13 cents on the dollar following a week-long mediation.  From beginning to end, the lawyers of Lindborg & Drill were able to achieve such a result in less than 30 days.

Lindborg & Drill Win Dismissal of Fraudulent Conveyance Claim
Representing the interests of a national contractor defending a $125 million fraudulent conveyance claim brought against it by a project lender in Nevada, the lawyers of Lindborg & Drill recently won a complete dismissal of the claim against their client.  Filing numerous motions concerning claims brought in a multiplicity of jurisdictions, the lawyers of Lindborg & Drill succeeded in convincing the District Court in Nevada that the lender was bound by a previous judgment involving the project owner.

Lindborg & Drill Achieves Victory in Arbitration
The lawyers of Lindborg & Drill were recently selected to represent the interests of a contractor in a claim brought against it by a project owner.  The owner had proven so difficult to work with that the contractor was willing to walk away from its contract balance and pay the owner an additional sum of money to settle the dispute.  Fortunately for the contractor, the project owner rejected the settlement offer and the matter proceeded to arbitration.  After a full hearing on the merits, the lawyers of Lindborg & Drill won an award for the contractor consisting of its contract balance, extra work claims, attorneys’ fees and costs.

Lindborg & Drill Performs Legal Feasibility Study for Toll Road and Border Crossing
Lindborg & Drill was recently asked to perform a legal feasibility study on behalf of a large public agency considering the construction of a new toll road leading to a new port of entry on the international boundary with Mexico.  The twist to the assignment was that it had to be completed in a three-week time frame.  Marshalling their own resources, as well as those of their industry contacts and their Legalink colleagues, the lawyers of Lindborg & Drill were able to complete the study, which considered relevant aspects of state, U.S. and Mexican law, on time and within budget.  The study aided the client in its negotiations with Washington and the project has been fast-tracked for funding consideration in the first half of 2008.

Lindborg & Drill LLP announces that Peter F. Lindborg has been named Chairman of Legalink’s Construction Special Interest Group.  Legalink is an international consortium of over 2500 lawyers in more than 45 countries worldwide.  Lindborg & Drill LLP is Legalink’s sole representative in Los Angeles.

Lindborg & Drill Participates in the First CIS Local Counsel Forum
Lindborg & Drill LLP took part in the first CIS Local Counsel Forum, organized in Kiev, Ukraine on June 29 & 30, 2006. The mission of the Forum was to bring the international legal community together with the CIS, with the aim of creating joint business opportunities and long-term cooperation among businesses and law firms.  Participation in the Forum was by invitation only and included distinguished individuals from around the world as well as the CIS legal, business and academic community.  The Ukrainian media and key government officials were also in attendance at the Forum.

The Forum was the first ever wide-scale meeting of the international legal community with the local counsel law firms of the CIS economic region (Armenia, Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Turkmenistan, Ukraine, Uzbekistan).  The Program spanned across two days, with the first day consisting primarily of the CIS regional panels, including local counsel from Russia, Ukraine, Belarus, Moldova and Central Asia, with a showcase of the host country, Ukraine, as well as a key presentation on the proposed CIS Counsel Association with the next meeting likely to be held in Baku, Azerbaijan in 2007.  The second day consisted of substantive panels devoted to specific areas of law with discussions on recent developments in various jurisdictions as well as the law relative to mergers & acquisitions, dispute resolution, intellectual property and natural resources.
